Join our Balfour Beatty Kilpatrick team as a Senior Commercial Manager and you can build something to be proud of here., The Senior Commercial Manager, is responsible for the commercial management of projects within the Work Winning arena. To support coverage across all Work Winning activities the Senior Commercial Manager shall act as an interface between Work Winning and Commercial teams, to draw on resource from the extended commercial team where required., As a/an Senior Commercial Manager, you will be accountable for acting as an interface between Work Winning and the Commercial function to undertake the following activities;

  • Effectively contribute and support the preparation of the Gated Business review papers through Gates 1-4
  • Prepare and deliver Commercial and Legal Gate 5 awareness sessions for the BBK delivery teams.
  • Carry out reviews to ensure Ancillary documents such as Collateral warranties, Non-Disclosure Agreements etc. are approved in line with BBK governance.
  • Provide commercial input to Value Engineering reviews for different forms of construction.
  • Actively participate in Tender Settlement Reviews
  • Actively input to Commercial and Fee/Profit strategy
  • Support account management activities to evolve customer relationships.
  • Liaise with JV partners on all commercial/ contractual matters.
  • Be proactive in ensuring 'lessons learned' from previous projects are flagged, mitigated or de-risked through contract negotiations.
  • Identify requirements for Insurances, Bonds, Warranties, Guarantees and any other agreements and
  • engage with Treasury, insurance, and legal advisors accordingly.
  • Update the Contract Review to represent the final position prior to Tender Submission Approval and advise SBU/ GTIC via presentation of the shift statement.
  • Liaise with Work Winning and Commercial Director, as required.
  • Support and provide advice to all post tender submission queries/ negotiations including assistance with developing the negotiation plan and leading customer negotiations.
  • Effectively manage early contractor involvement/ preferred bidder negotiations through to
  • agreement of the Target Cost / Financial Close/Contract Award.
  • Arrange for the Contract to be executed in accordance with the Delegated Levels of Authority
  • Attend the Tender Handover Meeting, and gate 5, and compiles/ completes all relevant commercial
  • information for inclusion within the Handover Package for formal hand over to the Project Team.
  • Support the forecast and control of Operational Overhead through Gates 1-4

    The following qualities/experience are essential:
  • Has extensive knowledge of the construction industry and/or major projects or Infrastructure experience within a project-based delivery organisation.
  • Expert working knowledge of NEC3 and NEC4 form of contract.
  • BSc or MSc in Quantity Surveying and/or LLB/LLM or significant equivalent experience.
  • Membership of RICS, ICES, CIOB or Law Society
  • Has extensive knowledge and experience of negotiation and agreement of FEED, Professional Services Agreements, Alliance Agreements, Joint Venture Agreements and complex, high value engineering and construction contracts; particularly NEC contracts.
  • Appreciation of procurement routes and contract terms and negotiation skills
  • Ability to gain a high-level security clearance.
